Understanding Probate in California
The process begins when an individual passes away. The person who is nominated
as the executor will file a petition along with the will, with the court
requesting that they be named as executor. Notices are then sent to heirs
and relatives informing them of when and where the hearing is to be held.
The hearing provides an opportunity for an objection to be heard or for
the validity of the will to be contested. If there is no objection and
no successful contest of the will, the executor is named, and they begin
estate administration.
The executor will then take an inventory of all assets, locate creditors,
pay bills, file tax returns, and manage the assets of the estate until
they are to be distributed. Once all duties of the executor are complete,
a petition is filed requesting that the remaining assets be distributed
to the beneficiaries. After this process is complete, final tax returns
